Gearbox Noise - 3rd Gear

Hi Guys. My stock 1997 S40 Gearbox (170.000kms) brings me here:
I have troubles with the gear engaging at 3rd when changing from 2nd or 4rd revving above 3000 rpm.
There is always a scratch noise.
On the other hand, when letting the revs come down, and change slowly, the gear engaging does not scratch
The car had a long stop time this winter, do you think the Honda Gearbox Oil is dead?
The clutch state is unknown but gear change on rev-limitter is normally not a problem.
I will check the current oil level, inspect it and bring some news.
I am concerned that the gear selector might be the problem.
Do you have similar experience?
